Welcome to Homemade by Colleen (“we,” “our,” or “us”). These Terms and Conditions govern your relationship with Homemade by Colleen and your use of our meal preparation and delivery services, including our website at homemadebycolleen.com (“Website”).

By accessing our Website, placing an order, or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding. If you do not agree with any part of these terms, please do not use our services.

2. Service Description

Homemade by Colleen provides fresh, homemade meal preparation and delivery services in the South Hills area of Pittsburgh, PA, including Bridgeville, McMurray, Mt. Lebanon, Nevillewood, Oakmont, Peters Township, South Fayette, and Upper St. Clair.

We prepare fresh, healthy, and homemade meals that are delivered directly to your doorstep. Our meals are prepared with high-quality, locally-sourced ingredients whenever possible, and our menu changes weekly to provide seasonal variety.

3. User Accounts

3.1 Account Creation

To place orders, you must create an account on our Website. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. You agree to accept responsibility for all activities that occur under your account.

4. Ordering Process

4.1 Menu Selection

Our menu changes weekly and is published on our Website. You may select meals from our current menu within the ordering period.

4.2 Order Deadlines

Orders must be placed by Thursday at 11:59 PM ET for the following week’s delivery. Any orders received after this time will be processed for the subsequent delivery cycle.

4.3 Minimum Order

We require a minimum order of 2 meals per delivery.

4.4 Pricing and Payment

• All prices are listed in US dollars and do not include tax.
• Payment is due at the time of order.
• We accept major credit cards and other payment methods as indicated on our Website.
• You will be charged at the time your order is placed.

4.5 Order Modifications

• Orders may be modified up until the order deadline (Thursday at 11:59 PM ET).
• After the order deadline, no modifications can be made as meals enter production.

5. Delivery

5.1 Delivery Schedule

Deliveries are made on the scheduled day you select during checkout. Our delivery windows are typically between 2:00 PM and 8:00 PM.

5.2 Delivery Areas

We currently deliver to the South Hills area of Pittsburgh, PA, including:

• Bridgeville, PA
• McMurray, PA
• Mt. Lebanon, PA
• Nevillewood, PA
• Oakmont, PA
• Peters Township, PA
• South Fayette, PA
• Upper St. Clair, PA

5.3 Delivery Fees

Delivery fees vary based on location and will be calculated at checkout.

5.4 Accepting Deliveries

• Someone should be present to accept the delivery whenever possible.
• If you will not be present, please provide specific delivery instructions during checkout.
• We will leave deliveries in the designated location if you are not present, but we are not responsible for stolen, damaged, or spoiled meals after delivery has been made.
• You are responsible for promptly refrigerating your meals upon receipt.

6. Cancellations and Refunds

6.1 Order Cancellations

• Orders may be canceled up until the order deadline (Thursday at 11:59 PM ET) for a full refund.
• Orders canceled after the deadline cannot be refunded as your meals have entered production.

6.2 Subscription Cancellations

If you have a recurring order, you may cancel your subscription at any time through your account. Please note that cancellations must be made before the order deadline to prevent charges for the upcoming delivery cycle.

6.3 Refund Policy

• Refunds are only issued for orders canceled before the order deadline.
• If you receive damaged or incorrect meals, please contact us within 24 hours of delivery for resolution.
• We may offer a replacement, credit, or refund at our discretion for valid quality concerns.
• Refunds will be processed using the original payment method.

7. Food Safety and Handling

7.1 Food Safety

All food is prepared in accordance with applicable food safety regulations. We maintain strict health and safety standards in our kitchen.

7.2 Storage Recommendations

• All meals should be refrigerated promptly upon delivery.
• Meals should be consumed within 3-5 days of delivery for optimal freshness and quality.
• Meals may be frozen for longer storage, but quality may be affected.

7.3 Food Handling Disclaimer

Homemade by Colleen accepts no responsibility for food that has been improperly stored or handled after delivery. After meals are delivered, they should be refrigerated promptly. Failure to promptly refrigerate meals will absolve Homemade by Colleen of any liability for meals that have been improperly stored after delivery.

8. Allergies and Dietary Restrictions

8.1 Allergen Notifications

We prepare food in a kitchen that handles common allergens, including but not limited to nuts, gluten, dairy, eggs, soy, and seafood. Cross-contamination is possible despite our best efforts.

8.2 Allergen Responsibilities

If you have allergies or dietary restrictions, you must notify us when placing your order. We will make reasonable efforts to accommodate your needs, but we cannot guarantee that any meal is completely free from a specific allergen.

8.3 Health Disclaimer

Our meals are intended for consumption by healthy adults. They are not intended for use by individuals with certain health conditions without consulting a healthcare provider. Consuming raw or undercooked ingredients may increase your risk of foodborne illness.

• Any issues related to the quality or safety of meals after delivery
• Unauthorized access to or alteration of your data

11.3 Indemnification

You agree to indemnify, defend, and hold harmless Homemade by Colleen, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:
